Terms of Service

Acceptance of Terms

By accessing or using the HeyProactive mobile application and related services (the “Service”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. The Service is provided by HeyProactive.ai (“HeyProactive,” “we,” “our,” or “us”).

License to Use

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial home-management purposes, subject to these Terms.

User Accounts

  • You must provide accurate and complete information.
  • You are responsible for maintaining the security of your account.
  • You must be at least 18 years old to create an account.
  • One account per person.

Prohibited Conduct

You agree not to:

  • Use the Service for any illegal purpose.
  • Interfere with or disrupt the Service.
  • Attempt to gain unauthorized access to the Service or other users' data.
  • Upload malicious code or content.
  • Impersonate others.

Service Partners

  • We may facilitate connections with service professionals.
  • We do not employ service partners directly.
  • You are responsible for any agreements you make with service partners.
  • We recommend verifying credentials and insurance before hiring.

Text Messaging (SMS)

The Service can relay service coordination messages between homeowners and their saved service partners by SMS. Messaging is initiated by the homeowner from within the app; the first message identifies HeyProactive and the homeowner and includes opt-out instructions. Message frequency varies based on service activity, and message and data rates may apply. Reply STOP to opt out and HELP for help. Mobile opt-in data and phone numbers are not sold or shared with third parties or affiliates for marketing or promotional purposes. See the SMS Messaging Policy.

AI-Generated Content

The Service uses AI to read and structure the documents and photos you submit. AI output may be incomplete or inaccurate and is provided for your convenience. You are responsible for reviewing and confirming extracted information before relying on it.

Payments

The Service may offer paid features in the future. If and when paid features are offered, applicable fees will be disclosed before any transaction and payment processing will be handled by third-party payment processors. No paid subscription is required to use the core Service today.

Limitation of Liability

THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR: the quality, timeliness, or outcome of any service partner's work; property damage arising from services arranged through the Service; or any indirect, incidental, or consequential damages.

Indemnification

You agree to indemnify and hold harmless HeyProactive from claims arising out of your use of the Service or your violation of these Terms.

Termination

We may suspend or terminate your access at any time for violations of these Terms or for other reasons at our discretion. You may stop using the Service and delete your account at any time.

Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law principles.

Changes to These Terms

We may modify these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the modified Terms.
